Case Summary: SafeWork NSW v Momentum Consulting Group [October 2025] by Risk Collective

An on-hire worker was seriously injured at a host site, leading to a court finding that Momentum Consulting Group (the on-hire firm) breached its WHS duty of care. The firm failed to assess site risks, verify host safety measures, or maintain meaningful engagement with workers.

 

This case reinforces that on-hire firms must actively understand host environments, assess risks, and maintain communication with both clients and workers to meet WHS obligations and protect on-hire staff.
