Fair Work Commission upholds flexible work request - Gadens

Following a flexible work arrangements dispute, the Fair Work Commission ordered Metcash to approve an administrative employee’s request to be exempted from a return to the office mandate. The Commission found Metcash failed to properly consider the personal consequences of refusing the employee’s request and lacked evidence to support reasonable business grounds for its refusal. The decision underscores the importance of consultation, and reinforces the importance of documented, credible evidence of reasonable business grounds to justify any refusal.
